Terms of Service

These terms govern your use of the Tretanz Infotech website. They do not replace written client agreements for paid project work.

They do not replace or override any separate proposal, statement of work, master services agreement, non-disclosure agreement, or other written agreement between you and Tretanz for paid services or partnerships.

The Website may display portfolio items, case studies, testimonials, client logos, screenshots, and other materials related to projects we have completed or contributed to. We display such materials where we have permission or otherwise have the right to do so.

Client names, trademarks, logos, product names, and other third-party intellectual property remain the property of their respective owners. Their appearance on the Website does not imply endorsement, partnership, or affiliation unless we explicitly state otherwise.

10. Information Submitted Through the Website

11. Project Inquiries and No Client Relationship

Submitting an inquiry, quote request, partnership request, job application, or other form through the Website—or contacting us by email or through scheduling tools linked from the Website—does not create a client, partnership, agency, reseller, employment, contractor, or other contractual relationship with Tretanz.

This includes submissions through general contact pages, careers pages, and agency or white-label partnership landing pages. A business relationship begins only when both parties agree in a written proposal, statement of work, master services agreement, or other applicable contract that is accepted or executed by the parties.

We may review, decline, or prioritize inquiries at our discretion. Nothing on the Website guarantees availability, pricing, timelines, acceptance of a project, or continuation of discussions.

Matters such as scope, deliverables, pricing, payment schedules, revisions, intellectual property transfer, warranties, support, confidentiality, termination, refunds, delays, and project-specific dispute resolution are governed by the applicable written client agreement—not by these Terms.

12. Third-Party Websites and Services

The Website may contain links to third-party websites, platforms, or services, including social media pages, scheduling tools, maps, and external resources. These are provided for convenience.

We do not control third-party services and are not responsible for their content, policies, availability, or practices. Your use of third-party services is subject to their own terms and privacy policies.

The Website may also use third-party measurement and advertising technologies—such as Google Tag Manager, Google Analytics, Microsoft Clarity, Google Ads, and Meta Pixel—only when you allow the relevant cookie categories through our cookie banner or cookie settings. 15. Limitation of Liability

To the fullest extent permitted by applicable law, Tretanz Infotech and its directors, officers, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity arising out of or related to your use of—or inability to use—the Website.

To the fullest extent permitted by applicable law, our total liability for any claim arising out of or relating to the Website or these Terms will not exceed one hundred U.S. dollars (USD $100) or the minimum amount permitted by applicable law, whichever is greater.

Some jurisdictions do not allow certain limitations of liability. In those cases, the above limits apply only to the extent permitted by law.

Liability related to paid project work, deliverables, or ongoing services is governed by the applicable client agreement, not by these Website Terms.

16. Indemnification

If you use the Website in violation of these Terms or applicable law, you agree to indemnify and hold harmless Tretanz Infotech and its directors, officers, employees, and contractors from claims, losses, liabilities, damages, and reasonable expenses (including legal fees) arising out of or related to:

  • Your misuse of the Website
  • Content or information you submit through the Website
  • Your violation of these Terms or any applicable law
  • Your infringement of any third-party rights

This section applies to Website use only and does not replace indemnity or liability provisions in any separate client agreement.

17. Privacy, Cookies, and Marketing Technologies

You agree that the courts located in Rajkot, Gujarat, India will have exclusive jurisdiction over disputes arising out of or relating to these Terms or your use of the Website, subject to the informal resolution process below.

Please include a clear description of the issue and the relief you seek. If the matter is not resolved within thirty (30) days after we receive your notice, either party may pursue remedies in accordance with this section.

Project-specific governing law, jurisdiction, or dispute-resolution terms for paid engagements are governed by the applicable client agreement—not by these Website Terms.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

20. Waiver

Our failure to enforce any provision of these Terms will not be treated as a waiver of that provision or any other provision. Any waiver must be in writing and signed by an authorized representative of Tretanz to be effective.

21. Changes to These Terms

We may update these Terms from time to time to reflect changes in our Website, business practices, or legal requirements. When we do, we will revise the “Last updated” date at the top of this page.

If changes are material, we may provide additional notice where appropriate. Your continued use of the Website after updated Terms become effective constitutes your acceptance of the revised Terms, subject to applicable law.
